The grace period for ensuring cannabis and CBD labels are compliant with new Proposition 65 regulations, has expired.
New Prop 65 label requirements for cannabis and CBD products took effect on January 3rd 2021 after a one-year grace period.
Any companies who manufacture, distribute or sell THC products in California—including those made from industrial hemp—are now required to warn consumers that exposure to this drug can cause reproductive harm. This includes items that have any detectable level of THC, such as products infused with cannabis or CBD.
Any sellers that do not adhere to these new regulations may be liable for a per-day per-violation fine of up to $2,500 USD.
